Terms of Service

1. Definitions

• Service: ScanPay platform for processing invoices and generating QR codes
• User: Any person who uses our service
• Account: Personal user account on our platform
• Credits: Virtual units used to process invoices

2. Applicability

These terms of service apply to all services offered by ScanPay. By using our service, you agree to these terms.

ScanPay is a technical service provider, not a payment service provider. Based on the data you enter, our service generates a payment QR code following the open EPC/SEPA standard and makes it available through a shareable payment page. We do not receive, hold or process any funds ourselves: a payment always takes place directly between the payer and the beneficiary's bank. ScanPay does not initiate or execute any payments and is therefore not subject to the licensing requirement for payment service providers (PSD2).

3. Account registration

• You must provide a valid email address
• You are responsible for keeping your login details confidential
• You are responsible for all activity under your account
• You must inform us immediately if you suspect unauthorised use

4. Use of the service

Permitted use:

• Processing legitimate invoices
• Generating QR codes for payment purposes
• Personal and business use

Prohibited use:

• Uploading false or fraudulent documents
• Misuse of the service for illegal activities
• Impersonating another person or organisation
• Using an IBAN you are not authorised to use, or setting up an unlawful collection of funds
• Reverse engineering our software
• Automation without permission

Do you suspect misuse of a payment page shared via ScanPay (for example fraud or impersonation)? Report it at [email protected]. We review reports and may suspend payment pages and accounts.

5. Credits and payments

• Credits are required to process invoices
• New users receive 5 free credits
• Credits do not expire
• Payments are processed via Stripe
• Refunds are possible within 14 days of purchase

6. Availability and maintenance

• We aim for 99% uptime but cannot guarantee it
• Planned maintenance is announced in advance
• We are not liable for damage caused by downtime

7. Data processing

• Uploaded invoices are processed automatically
• Invoice data is retained for 30 days
• We only extract relevant payment data

8. Intellectual property

• All rights to our software and service belong to us
• You retain ownership of your uploaded documents
• You grant us permission to process your documents for our service

9. Liability

• We are not liable for errors in extracted data
• Always check the data before making a payment
• You are responsible for the accuracy of the name, IBAN and amount before you share, print or pay a payment QR code or payment page
• We do not guarantee that a payment is executed correctly or on time, nor that the beneficiary of a shared payment page is the rightful recipient
• Our liability is limited to the amount you have paid
• We are not liable for indirect damage

10. Termination

• You can delete your account at any time
• We may suspend accounts in case of misuse
• On termination your data is deleted in accordance with our privacy policy

11. Changes

We may change these terms. Significant changes are announced by email. Continued use after changes means acceptance of the new terms.

12. Governing law

These terms are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.
